These regulations may be cited as the Printing Industry [Remuneration Order] Regulations 1984. 2. In these regulations - "apprentice" means a worker who - (a) is not less than 15 years old; (b) has passed the Certificate of Primary Examination; and (c) is employed solely for the purpose of learning his trade; 21/96 "archivist" means a worker who does one or more of the following duties - (a) collecting, organising and preserving documents; (b) analysing and preparing brief descriptions of contents of retained documents for reference; (c) undertaking restoration of documents in poor condition; 104/90 "assistant supervisor" means a worker who works under the direction of the supervisor (skilled workers) and is responsible for ensuring the proper carrying out of duties by workers under his supervision; 104/90 "attendant" means a male person who performs manual tasks involving physical effort but no particular skill; "binder/cutter" means a worker who - (a) performs a series of tasks in binding books or other printed materials by hand or by machine; (b) sews together signature to form book bodies with sewing machine; (c) compresses sewn together signatures of book bodies to uniform thickness with smashing machine; (d) trims books to size with powered cutting machine; (e) inserts each book into machine which rounds backs and forms grooves at back edge in which covers are hinged; (f) stacks and aligns books and glues superlining and backlining on each book; (g) glues cover to end sheets and places books in press to dry; (h) may be required to fabricate cover for book, cut and trim cover material; (i) may be required to emboss designs and titles on covers and decorate book edges with plain or mixed colours; and (j) may be required to operate various types of machinery connected with binding and cutting of printed materials; "cameraman and platemaker" means a worker who - (a) photographs matters to be printed by adjusting camera; (b) mounts copy to be printed and illuminates it; (c) places fine cross-lined glass screens between film and copy for half-tone printing; (d) develops film to obtain negative and examines negative for defects; (e) does retouching at film and plate level; (f) prepares photo sensitive glass plates; and (g) prints negative on plates, etches and retouches metal plates; "casual worker" means a worker specified in regulation 3(6); 104/90 "clerk" (a) means a worker employed for the purpose of performing clerical or similar duties; (b) does not include a receptionist/telephonist or a typist; "continuous employment" means the employment of a worker under an agreement, or under more than one agreement where the interval between an agreement and the next does not exceed 28 days; "earnings" - (a) means basic wages; and (b) includes remuneration paid under paragraphs 2, 6 and 8 of the Second Schedule; (GN No 104/90 & GN No 21/96) 104/90 "flexographic machine operator" means a worker who - (a) sets and operates satisfactorily a machine in which a range of flexible materials in reels (including paper and paper laminates, polyethylene, polypropylene and allied products, cellophane and allied products, laminates of all kinds and aluminium foil) are printed in line; (b) cleans inking rollers and replaces them in the machine; (c) mounts rubber or photopolymer or any other flexo plate on to plate-cylinders; (d) examines plates for defects; (e) washes plates when necessary; (f) packs back of plate to obtain desired printing thickness; (g) sets proper printing tension; (h) fills ink ducts and adjusts proper inking of print; (i) checks and adjusts ink viscosity; (j) checks substrates thickness; width and surface treatment for conformity; (k) adjusts proper temperature; (l) carries out make-ready; (m) starts press; (n) ensures that printing proceeds correctly; (o) ensures adjusted rewinding; (p) keeps record of weight of incoming unprinted reels and of printed outgoing reels; or (q) performs daily maintenance and cleaning; "foundry man" means a worker who operates a melting pot for the manufacture of ingots and who may be called upon to perform the work of helper; "hand compositor"means a worker who sets type of hand for printing and either -(a) examines manuscript to determine length of lines and type to be used; (b) adjusts guide in composing stick to required length of lines; (c) reads copy, selects type, arranges it in stick and inserts spaces to form line; (d) places leads between lines; (e) slides lines on to galley when composing stick is full or when set-up is complete and passes galley on for proof printing; (f) examines corrected proof, makes necessary alterations to type or set-up and sends the proof to pressman; (g) distributes type into proper compartments after use; (h) prints and corrects own proofs; or (i) prepares layout and makes up pages of type; 104/90 "helper" means a worker who does one or more of the following duties - (a) helping machine operators; (b) attending to the upkeep of machines and the placing of forms on machines; (c) assisting workers engaged on the placing or carrying of forms and galleys; (d) performing any other work to assist another worker; 104/90 "Letter press machine operator" means a worker who - (a) sets and operates a cylindrical process/platen printing machine; (b) cleans, fills, places and regulates inking rollers; (c) locks type on press bed and adjusts printing surface for correct pressure; (d) operates machine to obtain proof sheets and corrects surface pressure where necessary; (e) sets and adjusts paper guides, paper feeding and counting system and ensures that printing proceeds correctly; and (f) performs daily maintenance; 21/96 "linotype operator" means a worker who - (a) operates keyboard of machine which selects corresponding matrices of letters from magazines, assembles them in lines and automatically casts a strip of type (slug) for each line; (b) sets marginal stops and gauges according to length and thickness of lines to be formed; (c) reads original copy and presses keys of keyboard so that matrices are selected from magazines and assembled into a line; (d) starts mechanism to cast slug when line is complete and deposits it in galley; (e) passes galleys on for proof printing; (f) maintains supply of type metal in melting -pot of machine; (g) specialises in a particular kind of linotype machine, such as intertype machine; (h) works on numerical-control linotype machine; or (i) performs daily maintenance; "layout artist" means a worker who - (a) prepares designs or layouts for books, magazines, posters, charts etc. as per specifications of the clients, or on his own judgment; and (b) arranges type or illustrations and prepares final copy for printing; "monocaster operator" means a worker who - (a) sets up and operates machine which automatically casts lines of type for printing; (b) places perforated roll of paper on holder, threads end of paper through machine guides and attaches it to winding roll; (c) sets machine composing stick to length of line according to instructions; (d) selects matrix case and fixes it in position and locks galley on bed of machine; (e) starts machine, sees that casting is proceeding correctly and maintains supply of molten metal and cooling water; (f) stops machine when galley is full or paper roll is finished; (g) removes galley and passes type on for proof printing; (h) removes and stores paper strip; (i) operates machine to cast hand-set type or typesetting characters; or (j) performs daily maintenance; "monotype keyboard operator" means a worker who - (a) operates keyboard of machine which perforates strips of paper for use in a monotype casting machine; (b) examines copy, selects and installs keyboard on machine according to size and style of type required, sets and locks scale to indicate spacing of words in line; (c) inserts paper roll through guides on machine; (d) admits compressed air to machine; (e) reads copy and presses keys of keyboard to obtain required perforation in paper strip; (f) spaces out lines as necessary; (g) removes perforated strip from roll and passes it on for type casting with instructions; (h) works on numerical-control-monotype machines; or (i) performs daily maintenance; 104/90 "offset/lithographic machine operator" means a worker who - (a) sets and operates a machine in which separate sheets of paper, tinplate or other materials are printed by roller which obtains an ink impression from engraved (lithographic) plate; (b) cleans inking rollers and replaces them in machines; (c) examines plates for defects; (d) washes plate to remove protective coating and makes surface more ink-attracting; (e) packs back of plate with tissue paper to obtain desired printing thickness; (f) clamps plate in position on cylinder, adjusting it for correct tension; (g) inserts packing under rubber blanket of impression roller until roller has correct diameter; (h) fills ink fountain and regulates flow of ink on inking rollers; (i) adjusts space between cylinders according to thickness of sheets to be printed and sets water-damping rollers to deliver proper moisture to non-image portion of plate cylinder; (j) runs off several proof sheets and makes further adjustments if necessary; (k) sets and adjusts paper guides and checks paper feed; (l) starts press and ensures that printing proceeds correctly; (m) mixes ink and adjusts machine for numbering and perforating ; or (n) performs daily maintenance; "photo engraver" means a worker who - (a) prepares metal printing plates by photogravure process; (b) photographs copy of matter to be printed; (c) develops film and retouches negative if necessary; (d) prints negative on metal plate; (e) etches metal plate with acid; (f) retouches plate; (g) mounts plates on wooden blocks; and (h) may be required to make proof from finished plate; "photo-type setter" means a worker who - (a) operates keyboard of machine which reproduces letters on film or sensitised paper for eventual reproduction on printing plates; (b) places unexposed film or sensitised paper in photographic element of machine; (c) examines layout copy for typographical indications, such as spacing type-faces and length of lines; (d) starts machine and sets dial according to typographical instructions on layout copy; (e) reads copy and depresses keys of keyboard to reproduce required letters on film or sensitised paper; (f) manipulates machine controls as necessary to change type size and spacing, adjusts camera light and eliminates incorrect lines; (g) removes container with exposed film or sensitised paper on completion of operation and sends it to developing room; or (h) works on numerical control phototype setting machine; 104/90 "printing industry" - (a) means the industry relating to the printing of texts and illustrations on paper, metal, cloth or other materials; (b) includes - (i) the binding of texts and illustrations and other related tasks; (ii) the production of newspapers and periodicals; 21/96 "proof reader" means a worker who does either or both of the following duties - (a) comparing printers' proofs with original copies and marking errors for correction; (b) reading proof against copy and marking errors by means of a standardised code and returning marked proof for correction of type; 104/90 "receptionist/telephonist" means a worker who performs one or more of the following duties - (a) operating a telephone switchboard; (b) dealing with telephone enquiries; (c) receiving, recording and passing on telephone messages; (d) greeting callers and ascertaining wants; (e) supplying information to callers and directing them to persons called upon; keeping record of callers. 104/90 "rotogravure machine operator" means a worker who - (a) sets and operates a rotogravure printing machine; (b) cleans, fills, places and regulates inking rollers; (c) locks photo-engraved plates or cylinder on machine; (d) threads paper through machine guides and rollers; (e) adjusts rollers and paper-folding and cutting mechanism; (f) makes trial run, checks printing and makes further adjustment where necessary; (g) restarts machine and raises it to full speed; (h) at regular intervals checks and ensures that printing, folding and cutting proceed correctly; and (i) rethreads paper through press if web breaks; 60/85 "special category worker" means - (a) a worker who, in the absence of or on directions from a supervisor or assistant supervisor, assumes the charge or responsibility of a group workers; (b) a compositor in charge of large commercial or other advertisements; 104/90 (c) a machine operator in charge of the printing of a newspaper, or of a rotaprint or multilith machine; 104/90 "store attendant" means a worker who is employed in stores and is required to clean the stores, carry and deliver goods and perform other ancillary duties; 104/90 "storekeeper" means a worker who is responsible for the procurement, receipt, custody, issue, and keeping records, of goods in a store; 104/90 "supervisor (skilled workers)" means a person who is in charge of skilled workers and responsible for ensuring the proper carrying out of their duties; 104/90 "supervisor (unskilled workers)" means a person who is in charge of unskilled workers and responsible for ensuring the proper carrying out of their duties; 104/90 "typist" means a person who performs either or both of the following duties - (a) typing letters, memoranda, and similar matter according to written, dictated or other information; (b) making type written copies of existing records; 104/90 "unskilled worker" means a worker who performs either or both of the following duties - (a) manual tasks requiring no particular skill, on machine or otherwise; (b) errands; 104/90 "varnishing machine operator" means a worker who performs one or more of the following duties - (a) setting and operating a varnishing machine; (b) feeding the varnishing machine with paper and board and filling the varnishing tank; (c) checking at intervals the print quality and the viscosity of the varnish; (d) submitting daily production time sheet to the supervisor; (e) repairing or changing conveyor transport belt when damaged; (f) changing application of intermediate rollers; (g) ensuring that varnishing proceeds correctly; (h) cleaning and performing daily maintenance of the varnishing machine; 104/90 "watchman" means a worker who performs one or more of the following duties - (a) keeping watch over premises and property; (b) making periodic inspection tours in respect of buildings and ground and recording such entries as required; (c) keeping watch for suspicious persons and activities; "worker" means any person employed in the printing industry. 21/96 3 (1)(a) Subject to subparagraph (b) and to regulation 5, every worker specified in the First Schedule shall be - (i) remunerated at the rates specified in the First Schedule; (ii) governed by the conditions of employment specified in the Second Schedule. 104/90 (b) Where an offset machine operator or photo engraver is, at the commencement of these regulations, already in the service of an employer, he shall paid the next higher salary than the one he actually draws in the salary scale applicable to him. (2) Where a scale of wages applies to a worker specified in the First Schedule, he shall be entitled to - (a) subject to paragraph (1)(b), the initial wages specified in the scale which applies to him; and (b) one increment in respect of every year of service he reckons with his employer, other than as an apprentice, in the category in which he is employed. (3) Where a proficiency bar (P.B.) applies to a worker, he shall, before proceeding beyond the proficiency bar in the scale applicable to him, be able to perform satisfactorily a level of jobs clearly defined by management after consultation with the worker's representatives. (4) The rates specified in the First Schedule include the appropriate additional remuneration payable under the Additional Remuneration Act. (5) Where a worker is called upon to replace a worker drawing a higher remuneration, he shall be paid the remuneration applicable to that other worker. (6)(a) An employer may engage a worker on a casual daily basis for a period which shall not exceed 3 months. (b) Where, at the end of a period of 3 months, a casual worker continues to be employed, he shall be permanently employed in the appropriate category. (c) Where a casual worker has remained in continuous employment with the same employer for not less than 4 weeks, he shall be entitled to not less than one week's notice of dismissal. 21/96 (7) Where an apprentice has completed 4 years' service with an employer, or has successfully completed his apprenticeship under the aegis of the Industrial, Vocational and Training Board, whichever is the earlier, he shall be employed in the appropriate category in which he has served as apprentice. 104/90 (8) Where an employer who does not employ a mechanic on a permanent basis requires a machine operator who has experience in mechanics, to be in charge of a very highly automatic printing machine, the worker shall receive remuneration at the rate of Rs 7800 per month.(155/04) 4. Any agreement by a worker to relinquish his right to a paid holiday or to forego such leave shall be void. 5. Nothing in these regulations shall - (a) prevent an employer from paying a worker remuneration at a rate higher than that specified in the First Schedule or from providing him with conditions of employment more favourable than those specified in the Second Schedule; (b) authorise an employer to reduce a worker's remuneration or to alter his conditions of employment so as to make them less favourable. 6. The Printing Industry (Remuneration Order) Regulations 1975 are repealed. 7. These regulations shall be deemed to have come into operation on 25 October 1984. Made by the Minister on 21 November 1984. SECOND SCHEDULE (regulation 3) 1. Normal Working Hours GN No 104/90 (1) In the jobbing section of the printing industry the following conditions shall apply - (a) subject to the other provisions of this subparagraph, a normal working week shall consist of 45 hours; (b) an employer may operate 24 hours daily on an 8-hour shift system; (c) where no shift system is in operation the working hours shall be - (i) 8 hours on each of 5 days of the week to be performed between 6 a.m. and 5 p.m.; and (ii) 5 hours on one day of the week to be performed between 6 a.m. to 1 p.m.; (d) (i) the hours of work shall be exclusive of one hour for a meal; (ii) every worker shall be entitled during normal working hours to 15 minutes for a tea break with pay. (2) In the newspaper and periodical section of the printing industry the following conditions shall apply - (a) a normal working week shall consist of 45 hours; (b) a normal day's work shall, excluding one hour allowed for a meal, consist of 8 hours on each of 5 days of the week and 5 hours on one day of the week; (c) every worker shall be entitled on every working day to a tea break of 15 minutes with pay; (d) a worker may be required to work on a shift system, the first shift to be performed between 6 a.m. and 5 p.m. and the second shift between 3 p.m and midnight; (e) a worker may be required to work on a public holiday; (f) when a worker works on the second shift he shall, during the first hour's work, be provided with light refreshment. (3)(a) A normal working day for a watchman shall consist of 12 hours. (b) Where a watchman is required to work on every day of the month he shall be entitled to 3 days' leave without pay during the month, one of the days being a Sunday. 2. Extra Work GN No 104/90 (1) A worker who performs more than a normal day's work on any day, other than a public holiday, shall be remunerated at one and a half times the basic rate in respect of the additional hours of extra work which he performs. (2) A worker who works on a public holiday shall be remunerated - (a) for the 8 hours, at twice the basic rate; (b) thereafter at 3 times the basic rate. 3. Notional Calculation of Basic Rate For the purpose of determining remuneration due for extra work or for any other cause - (a) a month shall be deemed to consist of 26 days; and (b) a day shall be deemed to consist of 8 hours. 4. Payment of Remuneration GN No 104/90 (1) Every worker shall be paid his remuneration during working hours - (a) in the case of a monthly paid worker, not later than the second working day of the following month; (b) in any other case, not later than the last working day of the week. (2) Every employer shall, at the time of paying the remuneration of a worker, issue to him a payslip stating inter alia - (a) the worker's name; (b) his total wages and each item of allowance; (c) all deductions made and the reasons therefor; (d) the total number of days on which he was present at work; (e) the number of hours of extra work performed by him and the corresponding extra payment; (f) his social security number. 5. End of Year Bonus GN No 21/96 (1) Every worker who has remained in continuous employment with the same employer for one year, shall be entitled, at the end of that year, to a bonus equivalent to 1/12 of his earnings for that year. (2) Every worker who - (a) takes employment during the course of the year; is still in employment as at 31 December; and (c) has performed a number of normal days' work equivalent to not less than 80 per cent of the working days during his employment in that year, shall be entitled at the end of that year to a bonus equivalent to 1/12 of his earnings for that year. Seventy-five per cent of the expected bonus specified in subparagraphs (1) & (2) shall be paid not later than 5 clear working days before 25 December and the balance not later than on the last working day of the same year. (GN No 21/96) 6. Annual Leave (1) A worker who has remained in continuous employment with the same employer for 12 consecutive months shall be entitled to 16 days' leave on full pay in the following 12 months. (2) Eight days of the leave specified in subparagraph (1) may be taken consecutively at such time as the employer and the worker may agree or, in case there is no agreement, at such time as the employer may determine. (3) A worker who has not taken or been granted all the leave to which he is entitled under this paragraph, shall, except where he is, before the expiry of the period of 12 months, dismissed for misconduct, be paid a normal day's pay in respect of each day's annual leave still due at the end of that period. 7. Special Leave (1) A worker who has remained in continuous employment with the same employer for 12 consecutive months shall, on the occasion of his marraige, be entitled to - (a) 6 continuous working days' leave on full pay; and (b) an allowance representing the equivalent of his basic wages for work performed during 10 days. (2) No worker shall claim the leave and allowance specified in subparagraph(1) more than once . 8. Sick Leave (1) Subject to subparagraph (2), where a worker who has remained in continuous employment with the same employer for 12 consecutive months is sick, he shall, during the following 12 months be entitled to - (a) 21 days' sick leave on full pay; and (b) a further period of 30 days on half pay in respect of any time which is - (i) wholly spent in a clinic or hospital; or (ii) certified by a medical practitioner of the clinic or hospital as necessary for the recuperation of the worker's health after his discharge from the clinic or hospital. (2) A worker who is absent from work on ground of illness shall- (a) notify his employer of the illness on the first day of his absence ;and (b) forward a medical certificate to his employer so as to reach his employer not later than 10 a.m. on the fifth day of absence if the illness lasts for more than 4 consecutive days. (3) An employer may at his own expense cause a medical practitioner of his choice to examine a worker who is absent on ground of illness. (4) Where an employer employs a medical practitioner, a worker who is sick may, at the employer's expense be examined by that practitioner. 9. Maternity Leave and Benefits GN N0 21/96 &104/90 (1) Subject to subparagraph (2), where a female worker has remained in continuous employment with the same employer for 12 months immediately preceding her confinement she shall be entitled to - (a) 12 weeks’ leave on full pay to be taken at her discretion before and/or after confinement provided that at least 6 weeks' leave shall be taken immediately following the confinement; and (b) an allowance of Rs 500 payable within 7 days of her confinement. (2) Where a female worker who has at any time had 3 confinements is pregnant, she shall not be entitled to the benefits specified in subparagraph (1) but she shall be entitled to only the leave specified in subparagraph (1)(a) without pay. (3) Where a female worker suffers a miscarriage which is duly certified by a medical practitioner she shall be entitled to 2 weeks' leave on full pay. 10. Death Grant GN No 21/96 Where a worker who has remained in continuous employment with the same employer for not less than 12 consecutive months dies, the employer shall pay an amount of Rs 2000 to - (a) his spouse; or (b) if he leaves no spouse, the person who has borne the funeral expenses. 11. Transport Benefits and Facilities GN No 104/90 (1) Every worker shall be entitled to free transport or be paid the return bus fare where no free transport is available if the distance between his residence and the place where he reports for work exceeds - (a) 3.2 km (2 miles) in the case of a female worker; and (b) 4.8 km (3 miles) in the case of a male worker. (2) Where a worker is required by his employer to attend or cease work at any time when no public bus service is available, the employer shall, irrespective of the distance between the place of residence and the place of work, provide appropriate free means of transport from the worker's residence or from his place of work or both, as the case may be, provided that in these cases transport shall be provided up to the nearest practicable place from the worker's residence. 12. Medical Facilities GN No 21/96 A hand compositor, linotype or monotype operator, foundryman, proof reader or a worker on foundry duties who has remained in continuous employment with the same employer for 12 consecutive months, shall - (a) have his eyes tested, at the employer's expense, not less than once a year; and (b) be provided, where required, with glasses at the employer's expense. 13. Protective Equipment (1) Every employer shall provide - (a) one pair of leather gloves, goggles and boots to every foundryman or worker on foundry duties; (b) suitable hearing protection to every casting machine operator, linotype operator and monotype operator and to every worker who attends an automatic press in the newspaper printing industry; 104/90 (c) 2 overalls to every hand compositor, helper, offset/lithographic machine operator and photo-engraver; 104/90 (d) 2 uniforms to every machine operator. The protective equipment specified in subparagraphs (1) (a) and (b) shall be renewed whenever necessary. The protective equipment specified in subparagraphs (1) (c) and (d) shall be issued not later than 31 May in each year. (4) Every protective equipment specified in this paragraph shall remain the property of the employer 14. Issue of Milk Every foundryman or every worker who operates a casting machine or performs foundry duties shall be provided with 800 ml of milk on any day he performs foundry or casting machine operator duties. 15. Washing Facilities Every place of work shall remain open for half an hour after normal working hours to enable workers to wash and dress. 16. Work on Different Floors Where composition, laying or setting in of forms is carried out on more than one floor of a building, no hand compositor shall be required to carry a form from one floor to another. 17. Minimum Establishment GN No 60/85 & 104/90 (1) Where before the commencement of these regulations, an employer of more than 14 workers, employed one foreman in each batch of 15 workers, he shall appoint the seniormost foreman as supervisor and the other foremen as assistant supervisors. (2) Where an employer employs more than 14 workers, he shall, in each batch of 15 workers, employ not less than one assistant supervisor and one special category worker. (3)(a) Where an employer employs not more than 3 workers excluding apprentices or helpers, he shall employ not more than one apprentice. (b) Where an employer employs more than 3 workers excluding apprentices or helpers, he shall, in respect of each group of 4 workers, employ not more than one apprentice. (4) Where an employer employs 7 or more unskilled workers and/or helpers, he shall employ one supervisor (unskilled workers). (5) For the purpose of this paragraph, no account shall be taken of an employer who is also a worker in this establishment. 18. Allowance to workers performing the duties of a Foundryman Every worker who, in addition to his normal duties is required to perform the duties of a foundryman, shall be entitled to an allowance of 15 per cent of his wages for that day. 19. Gratuity on Retirement Before 60 on Medical Ground GN No 104/90 & Reprint 4/90 (1) Where a worker who has been in the continuous employment of an employer for not less than 10 years retires before the age of 60 on the ground of permanent incapacity to perform his work duly certified by a Government Medical Practitioner, the employer shall pay a gratuity to him. (2) The gratuity specified in subparagraph [1] shall be paid - (a) in a lump sum and calculated according to the formula N x W/2; (b) irrespective of any benefits the worker may be entitled to under Part V of the National Pensions Act. (3) For the purpose of subparagraph (2) (a) - (i) "N" means the number of years of service; and (ii) "W" means the last monthly wage. 20. Gratuity at Death GN N0 104/90 (1) Where a worker who has been in the continuous employment of an employer for not less than 10 years dies, the employer shall pay a gratuity. (2) Where the death of a worker in employment occurs after the age of 60, the gratuity under subparagraph (1) shall be payable only if the worker has not been paid severance allowance by the employer in accordance with the Labour Act after reaching the age of 60. (3) The gratuity specified subparagraph (1) shall be paid - (a) in a lump sum and calculated according to the formula N x W/2; (b) to the deceased worker's surviving spouse or, where he leaves no surviving spouse, in equal proportions to his dependants; (c) irrespective of any benefits the worker or his dependants may be entitled to under Part V of the National Pensions Act. (4) For the purpose of - (a) subparagraph (3)(a)- (i) "N" means the number of years service; and (ii) "W" means the last monthly wage; (b) subparagraph (3)(b)- (i) "spouse" means the person with whom the worker had contracted a civil or a religious marriage and with whom he lived under a common roof at the time of his death; (ii) "dependant" means any person who was living in the deceased worker's household and was wholly or partly dependent on his earnings at the time of his death. 21. Overseas Leave GN No 104/90 (1) Every employer shall grant to every worker reckoning continuous employment with him for a period of at least 15 years one overseas leave of at least two months to be wholly spent abroad. (2) At least one month of the leave specified subparagraph(1) shall be with pay, such pay being efected in advance and at least 7 days before the worker proceeds abroad. (3) For the purposes of annual and sick leave and end of year bonus, such leave shall be deemed to constitute attendance at work. 22. Subsistence Allowance GN No. 104/90 Where a worker who has completed a normal day's work is required to work beyond 7 p.m he shall be provided with an adequate meal or a meal allowance of Rs 20 per day.
