What is the Citizen’s Charter?

The charter is an undertaking to provide the highest level of service possible by meeting the standards contained in this document.

The process is ongoing to ensure that proper systems and procedures are in place to fulfill our stated commitments.

We will endeavour to improve on these standards as we strive to deliver excellent service to you all.

 


 
OUR ROLE
One of the Government’s main objectives is to create a society in which each citizen has every prospect of a better quality of life. The National Assembly plays a critical role in ensuring democracy.
OUR VISION
To transform the Department`s performance into one of excellence and in so doing contribute to the creation of a better quality of life for the people of Mauritius.
OUR MISSION STATEMENT

To ensure that the best interests of the Nation are served.
The main objectives of the Department are:

• to keep under continuous review the parliamentary service to enable Members of Parliament to discharge their duties in the best of conditions.

• to create the necessary service to enable the officers to provide improved service to Honourable members for them to be able to best serve the people of Mauritius.

• to interact with the Parliaments of the rest of the world in order to enhance the democratic principles to which we adhere to.

• to publicize and promote our parliamentary institution by helping the public to understand the role and operation of the National Assembly through information sharing by means of this Charter and of our web site.

SEVICES PROVIDED
Some of the services that are offered include providing accurate and timely information on matters such as the time and date of parliamentary sittings, the order paper, parliamentary questions and answers, bills to be introduced in parliament and the date they are passed, the committee compositions and their reports.
ABOUT US
The Parliament:

The Constitution of Mauritius provides for the Parliament of Mauritius to consist of the President and the National Assembly. The Parliament of Mauritius is modeled after the Westminster system of parliamentary democracy where Members of National Assembly are elected at regular general elections, on the basis of a first past the post system.
The last general election was held on 03 July 2005.


1. The President
The President of the Republic of Mauritius is the Right Honourable Sir Anerood Jugnauth, G.O.S.K. He assumed office on 30 September 2003.

2. The National Assembly
The Assembly is made up of 70 Members of whom 62 are directly elected in 21 constituencies. The island of Mauritius is divided into 20 constituencies returning 3 members each and that of Rodrigues is a single constituency returning 2 members.

After the last general election, the Electoral supervisory Commission nominated 8 additional members in accordance with section 5 of the First Schedule of the Constitution with a view to correct any imbalance in community representation in Parliament. This system of nominating members is commonly called the best loser system.

After the results of the general election were proclaimed, the President called upon the leader of the party/alliance having won a majority of seats to form the government. Thus, the Social Alliance, under the leadership of Dr the Honourable Navinchandra Ramgoolam, made up of the Labour Party, the MMSM, the PMXD , the MR and the MSD formed the government and its leader became the Prime Minister.

The MMM-MSM-PMSD Alliance had the second largest political majority and formed the Official Opposition and it`s leader, Paul Raymond Berenger, G.C.S.K. was nominated by the President of the Republic as the Leader of the Opposition.

Hon VALAYDEN Jayarama was also appointed as the Attorney General, Minister of Justice & Human Rights, under Section 69 of the Constitution.

The Assembly elected Honourable Rajkeswar Purryag, G.O.S.K., a non-elected member of the Assembly as the Speaker, Honourable Jean Francois Chaumiere, MP as Deputy Speaker and Honourable Surendra Dayal as Deputy Chairman of Committees.

Office of the Speaker

• The Speaker
The first business of the House is to elect a speaker when the Assembly first meets after a general election. The Constitution provides that the Speaker may or may not be an elected Member of the House.


The office of Speaker is presently held by Honourable Rajkeswur Purryag, G.O..S.K. He is not an elected Member of the House. The Government and the Opposition agreed on his candidature. He was elected and sworn in as Speaker on 12 July 2005 at the first sitting of the Fourth Session of the National Assembly. The Speaker holds office for the duration of the life of Parliament, unless he is removed earlier on by the Assembly.


The Speaker is the principal office holder of the House and its spokesperson in relation to the other constituent part of Parliament – the President of the Republic. The Speaker symbolizes the authority of Parliament.


The main function of the Speaker is to ensure that the Standing Orders and Rules of the National Assembly are complied with. The Speaker interprets and enforces the Standing Orders and for the purpose of interpretation, recourse is often had to Erskine May’s Parliamentary Practice, respond's to Member's points of order and give rulings when necessary. His ruling cannot be challenged, except on a substantive motion to that effect, and any criticism of his actions outside Parliament may amount to contempt of the National Assembly.


The Speaker decides on the admissibility of Questions to Ministers and on the choice of speakers during the debates and in so doing, he seeks to allocate the call evenly between the government and the non-government Members.
The Speaker must maintain order during debate and he can call members to order for use of ‘unparliamentary language’ for misbehaviour, or constant interruptions, for irrelevance in debates or for engaging in private conversations. The Speaker may order the Member, whose conduct is grossly disorderly to withdraw immediately from the House during the remainder of the day’s sitting. If a Member persistently flouts the authority of the Chair or willfully obstructs the business of the House, by abusing the Rules of the assembly, the Speaker may ‘name’ the Member.


The Speaker has ultimate responsibility, together with the Office of the Clerk, for the administration of Parliament and the operation of the Parliament House. Furthermore, the parliamentary precincts of the National Assembly are under the control and management of the Office of the Speaker.

The Deputy Speaker
At the beginning of each Parliament, the ouse also elects a Member to the position of Deputy Speaker, proceeding in the same manner as for the election of the Speaker. In the absence of the Speaker or whenever requested by the latter, the Deputy Speaker takes the Chair and has the same powers and functions as the speaker.
The Deputy Speaker is also the Chairman of Committees. He presides over the Committee of the whole Assembly, unless the speaker chooses to do so.

The Deputy Chairman of Committees
The Deputy Chairman of Committees is another official of the National Assembly elected from amongst its members. The process of election of the Deputy Chairman of Committees is similar to that of the Deputy Speaker. In the absence of both the Speaker and the Deputy Speaker, the Deputy Chairman of Committees presides over the Committee of the whole House.

Office of the Clerk

The Clerk of the National Assembly has overall responsibility for the central services provided by the National Assembly Office, notably financial services and administrative services, Hansard, Serjeant-at-arms and visitor services. The Office of the Clerk is equally responsible for the support of parliamentary operations. The Office of the Clerk is comprised of the following: Clerk of the National Assembly, the Deputy Clerk, Clerk Assistant.
Parliamentary Support, Administration and Protocol and Inter-Parliamentary Relations
The Office co-ordinates the National Assembly support services and ensures that all forms of business pass through each of the required procedural steps. The Office prepares, processes and maintains all legislative records and documents of the Assembly. It ensures the accuracy of the Proceedings, the Order Paper and the Minutes and reports of the various committees.
The Office co-ordinates the operation of and provide support service to standing, special and select committees of the assembly. This requires all logistical and legislative requirements of committees as well as procedural advice.
At the Table, the Clerks provide confidential and impartial advice pertaining to matters of parliamentary procedure and interpretation of the rules and practices of the Assembly to the Speaker and to Members of the Assembly.
The Clerk is responsible to the Speaker for the efficient and effective administration of the Assembly support services.


The Office co-ordinates all official parliamentary ceremonies and other formal occasions that involve the National Assembly, such as the official opening of the parliamentary sessions, election of Speaker, prorogation, dissolution, swearing-in of Members and visiting parliamentarians.
