These rules may be cited as the Supreme Court (Judge in Chambers) Rules 2002. 2. Unless otherwise provided in any other enactment, every application to a Judge in Chambers shall be made by way of praecipe, supported by affidavit and any relevant documentary evidence. 3. (a) Subject to paragraph (c) of this Rule, where an application is made to a Judge in Chambers, the praecipe shall clearly specify which aspect of the jurisdiction of the Judge in Chambers is being invoked, in accordance with the requirements set out in paragraph (b) of this Rule. (b) Where the jurisdiction being invoked- is that of the Judge in Chambers as "Juge des Rщfщrщs" under article 806 of the Code of Civil Procedure, it shall be so specified; is laid down in any other specific enactment, that enactment shall be mentioned and the precise provision of that enactment shall, where applicable, be specified. (c) In the case of an application for an Order for the issue of a writ habere facias possessionem or an interim or interlocutory injunction, no compliance is required with paragraphs (a) and (b) of this Rule. (d) A Judge may, acting proprio motu or at the instance of any respondent or co-respondent, set aside an application where the applicant fails to comply with this Rule, either straightaway or after giving the applicant's attorney an opportunity to comply with the Rule. 4. (a) An applicant shall disclose all relevant facts in his initial affidavit evidence in support of his application. (b) Any respondent or co-respondent may file one or more counter-affidavits, with appropriate documentary evidence annexed in support, in reply to the applicant's initial affidavit evidence. (c) An applicant may reply to any counter affidavit and annexe filed under paragraph (b) of this Rule by any further affidavit and, where, appropriate, documentary evidence annexed thereto. Any respondent or co-respondent shall have a final right of reply. No further affidavit or documentary evidence shall thereafter be filed except with the leave of the Judge. 5. (a) An affidavit shall only contain statements of fact which are relevant to the application and no adverse inferences shall be made against a party who does not reply to an allegation of fact which is clearly irrelevant. (b) Any document which a party wishes to put in as evidence. shall be by annexe to an affidavit wherein clear reference as to its pertinence to the application shall be made. (c) All documents annexed to an affidavit shall be marked and reference to those markings shall be clearly made in the appropriate paragraphs of the affidavit in which the documents are referred to. (d) Attorneys and, where appropriate, Counsel for the parties concerned, shall ensure that no sarcasm or unwarranted argumentation is introduced in any affidavit. (e) The Judge before whom the case is mentioned may make any order or adopt any measure to ensure compliance with paragraphs (a) to (d) of this Rule, including ordering, either proprio motu or at the instance of a party to the case, that any part of an affidavit or any document annexed thereto which is manifestly irrelevant or which otherwise does not comply with this Rule, shall not form part of the evidence in the case. 6. (a) Where an ex parte application is made to a Judge In Chambers and is set aside and another application is subsequently made by the same applicant and contains essentially the same prayer, the applicant shall in his new application disclose all the particulars of his previous application. (b) Where a Judge before whom an application has been lodged receives information to the effect that the applicant has failed to comply with paragraph (a), the Judge may, after hearing the applicant's attorney or Counsel in relation to the alleged non-compliance - (i) where he has not yet determined the application, set it aside; or (ii) where he has already determined the application, suspend any order made by him. 7. Where the filing of all affidavit and documentary evidence before the Judge has not been completed, the hearing shall not be definitely fixed. 8. (a) Subject to paragraph (b) no affidavit or document shall be allowed to be filed after the hearing has been fixed. (b) The Judge hearing the application may exceptionally allow any party to the case to file an affidavit or other document after the hearing has been fixed, having regard to - (i) the nature of the subject matter contained in the affidavit or other document; (ii) any reason put forward for not filing the affidavit or other document at the appropriate stage; (iii) the stand of any other party; (iv) the likelihood of the need for a postponement of the case upon the late production of the affidavit or other document; and (v) any other relevant consideration. (c) The Judge may, at the request of one of the parties or acting proprio motu, order that all or any of the parties shall personally attend the hearing of the application in Chambers whenever he considers that such presence will help in the determination or disposal of the application.
